Please read our User Agreement in it's before subscribing at one of our services. This Agreement control the conditions of the terms used by the Customer (User) for the services offered by OnHeberge.com hosting service of OnNet.ca Inc.

Obligations and Validity of the User Agreement

The Client who will receive a hosting service with OnHeberge.com will take and engagment to respect the rules and conditions of the User Agreement . This agreement is in force until the end of the contract.

Compliance and Law

The Client will use the services offered by OnHeberge.com on conformity with the federal laws of his country , province (state), and all international laws.The services offered by OnHeberge.com may be used for lawful purposes only.

Unacceptable practices includes are not limited at:

• All attemps with no authorization to one of our computer system
• Hacking
• Violation of copyright law
• Gambling
• Complot to fraud
• Obscene material
• Abuse of all kinds
• Violation of Canadian federal and/or provincial law.

OnHeberge.com reserved the right to forbid all practices that he judge immoral.

Prohibition

The Client shall not:

a)Send or post unsolicited messages or communications in any form ("SPAM");

b)Send or post harassing, abusive, libelous or obscene materials or assist in any similar activities related there to;

c)Delete misrepresent transmission information, including headers, return mailing and Internet addresses;

d)Forbid this kind of activities such as written below. If a Customer becomes aware of any Prohibited Activities, that is the cause the Customer must stop immediately this situation or he risk of closing his account.

OnNet.ca inc. reserve the right to examine the systems files, E-Mail and others datas regarding the contents of illegals materials on his servers or for any other reason deemed necessary.

Business Relationship between Parties

The parties intend that a independant business relation will be created by this agreement and that no association, joint-venture in participation or relation employee/employer is planned by this agreement.

Server Resources

The programs in operation on the Web servers of OnHeberge.com without written autorization like for example, chat rooms, Internet Relay Chat, IRC bots, more then 1000 E-Mails a day and other programs of similar nature are not acceptable of 15% or more of the capacity of our system ressources. This demand is non acceptable and not justified.

If you use more than (15%) of our systems resources or exceeding (10) Gigs of bandwidtd traffic may occur the shut down of your account immediately.

Hacking and Cracking

OnHeberge.com reserve the right to report all illegals activities and irregulaties to competents authorities, governmental and others for eventuals pursuits.

Content

Without limit, the transmission, storage or presentation of any information, datas or material in violation of any Canadian laws or a national right are forbidden by electronic E-Mail from our servers are strictly prohibited. OnHeberge.com will be the sole arbiter as to what constitutes a violation of this provision.

Backup

The Client is the only one responsable for doing backup and storage his datas. See our section about Backup Services to know more.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of OnHeberge.com Hosting is strictly prohibited.

IP Addresses

OnHeberge.com maintains control and remind the only proprietor of all IP numbers and addresses that may be assigned to Client and reserves in its sole discretion the right to change or remove any all IP numbers and addresses.

Good Client Information

The Customer is solely responsible for keeping all-personal and billing information current at all times. You may fax an update to 1 (514) 387-5906. Any fax must include the account name and signature of the account owner.

OnHeberge.com is not responsible for actions that are taken as a result of a customer's failure to respond to OnHeberge.com's notices

Selection of Services Bundle

The Client select hosting services offered by OnHeberge.com to create his services bundle. He accept to receive services according to the selected one, and agrees to pay for this service.

Resale

When the Client as the permission to resale the services provided by OnEnregistre.com only the Client is indepted towards a third partie.

Payment for Services

The Client will pay for services provided under our Billing Policy.

Satisfaction Guarantee

All customers users account on OnHeberge.com have a 30 days satisfaction guarantee. You must read carefully our criteria of guarantee.

Future Server Use and Rate

OnHeberge.com may, with a 30 days written notice by E-Mail, can amend the rates and/or via his Internet http://www.onheberge.com charges for any future server usage and/or services.

Cancellation of Service

We reserve the right to refuse, cancel or suspend service at our sole discretion.

Taxes

The Client must pay Canadian and Provincial taxes applicables.

Changing Condition of the User Agreement

OnHeberge.com can change at any time the using conditions of this agreement after emetting by E-Mail, a (3) days notice. If ever a Customer refuses these news conditions he could cancel his engagment contract at any time. If ever he decide to continue using the services of OnHeberge.com constitute the acceptation of the news conditions. OnHeberge.com will apply his rights and obligations only (10) days after the notice given by E-Mail.

Every Customer of OnHeberge.com must adhere to the above policies. Failure to follow any term or conditions will be grounds for immediate account deactivation without refund.
